Drug related charges can vary from minor possession charges to felony charges for drug trafficking. Depending on the type of drug, the quantity of the drug, and the circumstances of the arrest, the penalties for possessing or selling a given drug can vary from misdemeanor to felony.

Drug possession charges are separated into sections according to the drug in question. Possession of marijuana is covered under California Health and Safety Code 11357, possession of a controlled substance is covered under 11350 and 11377, and possession of a controlled substance with intent to sell is covered under 11359.1, 11359.2, or 11359.3.

The penalties for possession of marijuana depend on the amount of marijuana in question. Possession for personal use is a misdemeanor and is punishable by imprisonment in county jail for up to six months, a fine of up to $500, or both. Possession of more than 28.5 grams is a misdemeanor and is punishable by imprisonment in county jail for up to one year, a fine of up to $1,000, or both.

The sentence increases to four years if the offender has a prior conviction for possession of a controlled substance with intent to sell.

Drug Trafficking Charges

Depending on the quantity of drugs found on his or her person, a person can be facing drug trafficking charges instead of simple possession. Commonly used for drug dealers, drug trafficking charges are egregious felonies and are punishable by imprisonment in state prison for up to 10 years, a fine of up to $20,000, or both.

Possession of large quantities of a controlled substance is also a felony and is punishable by imprisonment in state prison for up to three years, a fine of up to $10,000, or both. If the person has a prior conviction for possession of a controlled substance, the sentence increases to four years.

Drug trafficking charges are serious felonies and bring a long term of imprisonment and a heavy fine. If you are facing drug trafficking charges, it is in your best interest to seek the advice of an experienced Los Angeles Drug Trafficking Lawyer.
