Domestic violence has several definitions, but the meaning generally applies to an incident of physical or verbal abuse between intimate partners, such as a married couple, or between family members.

The Violence Against Women Act defines domestic violence as a pattern of abusive behavior in any relationship that is used by one partner to gain or maintain power and control over the other.   • Economic abuse, such as preventing a partner from working, destroying a partner’s belongings, or preventing access to money

The law takes domestic violence very seriously, and victims of domestic violence have the option of pursuing criminal charges against their abusers. When an offender is convicted, he or she faces up to one year in county jail and/or up to $6,000 in fines.

Legal Action for Victims of Domestic Violence

The Violence Against Women Act, passed in 1994, provides victims with several avenues to seek legal relief. Victims can take action:

  • Divorce or separation
  • For child custody

  • For spousal support
  • To obtain legal immigration status
  • To seek public benefits

The Violence Against Women Act also provides victims with resources to help them escape their abusers. The law provides funding for shelters, counseling, and other resources, and it provides funding for the prosecution of domestic violence cases.

Many states have passed laws that protect victims of domestic violence. The laws vary from state to state, and they offer victims many different protections, such as the right to obtain a temporary restraining order and to seek a permanent restraining order.

Many states also provide victims with the option of obtaining a protection order that limits a defendant’s ability to contact the victim. A protection order may also include court orders that require a defendant to vacate the home shared with the victim and to stay away from the victim.

Victims of domestic violence also have the option of filing for divorce or legal separation, and many states offer victims the option of obtaining a civil protection order that is separate from any criminal proceedings.

Domestic Violence Penalties

Anyone convicted of domestic violence faces penalties, including imprisonment in county jail for up to one year and/or a fine of up to $6,000. A person convicted of a second or subsequent domestic violence offense faces two to four years in state prison and a fine of up to $10,000. A person convicted of inflicting great bodily injury receives an additional year in state prison.
